Dear Friends and Supporters,

We hope you have been well and are enjoying a pleasant fall season. Thank you for your continued
support. We are pleased to give you the following update regarding developments in our efforts to
preserve the Flowerfield property.

As you may be aware, the significant progress we have made over the past several years working with
our elected officials to ensure that the Flowerfield Fairgrounds property is instead preserved as open
space suffered a minor setback recently when the State Supreme Court denied the Article 78 petition filed
by the Coalition, Village of Head of the Harbor and neighbors of the property, charging that the
environmental review of Gyrodyne’s subdivision and development plan was insufficient.

We were encouraged to learn that the Court decision will not interfere with ongoing efforts by the New
York State Department of Environmental Conservation (DEC) and Suffolk County, which are working
together to ensure that Flowerfield Fairgrounds is preserved as open space, nor does it change the Town
of Smithtown’s decision to advise DEC that the Town has no objection to preservation of the property.
Importantly, new information about environmental impacts makes it critically important that we continue to press for a sufficient environmental review. It is clear that the Environmental Impact Statement (EIS) for Gyrodyne’s development plan simply did not consider severe rain and flooding events like the one that
caused the failure of the dam at Stony Brook Mill Pond on August 19th. In addition, the recent court
decision was perplexing in several respects, and findings that the project as proposed would be
consistent with the Town’s new Comprehensive Plan, and that the uses proposed are in conformance
with the zoning on the property, in particular, are puzzling.

After a comprehensive review, the Coalition and neighboring property owners who are parties to the
litigation have determined that we respectfully disagree with the Court’s decision, and have filed a Notice
of Appeal. For more details, click the button below to see the press release:

While we are all buoyed by the continuing strong support of elected officials including Suffolk County
Executive Ed Romaine, County Legislators Rob Trotta and Steven Englebright, and others for
preservation of the property, the legal challenge to the insufficient environmental review is important, and
must continue.

Financial support from members of the community has made all of the Coalition’s efforts, including the
ongoing legal action, possible. Please consider making a donation to the Coalition’s Legal Fund. Your
help will ensure that we are able to continue our fight on the Appeal and to convince the Court that the
impact of severe storm events must become part of the environmental review of Gyrodyne’s proposed
development plan. Remember, all donations are tax deductible.

Thank you,
