  • Commercialize the historic Mills Pond Road corridor forever, permanently altering our quality of life, reducing the value of our homes, and creating a traffic nightmare.

Here’s What’s Happening:

The Developer has filed a lawsuit in federal court to force the Town of Smithtown to hold a public hearing and has asked the Court to direct the Town to approve the assisted living facility. This would allow the Developer to move forward in violation of the Town’s new Draft Comprehensive Plan.

How You Can Help Stop the Development

  1. Write, e-mail or call members of the Town Board and urge them to schedule a public hearing and to formally DENY the application

Another assisted living facility or a peaceful farm?

THE FACTS

  • Because it is zoned for homes on one acre lots, the only use of the property that is
    permissible “as of right” is for single family homes
  • The developer’s application for a “special exception” to allow an assisted living facility in a residential zone DID NOT meet the requirements of the Town Code that existed at the time the application was submitted.
  • The Town Board cannot approve the application unless it finds “that the proposed location is appropriate…and gives due consideration to the character of the surrounding neighborhood” (Town Zoning Code Section 322-99 (A)
  • The Town’s Draft Comprehensive Plan recommends that such facilities NOT be allowed in residential neighborhoods
  • Suffolk County and the Peconic Land Trust want to purchase the property from the landowner to preserve Bull Run Farm as open space
