Despite the tremendous public opposition and a significantly flawed environmental review, the Smithtown Planning Board approved the Gyrodyne preliminary subdivision application on March 30, but it’s still NOT A DONE DEAL! The Coalition along with the Village of Head of the Harbor and 23 additional petitioners filed a lawsuit on April 26 against the Town of Smithtown and Gyrodyne. We need financial help from all of you who care. Litigation is expensive, as are the experts we need. We believe we have strong legal arguments showing the Town of Smithtown’s environmental review process which was concluded on March 30 did not comply with the requirements of state law.

We are making real progress with our proposed Compromise Plan since Gyrodyne is interested in selling the property on an ‘as is’ basis. This Plan thus far has been endorsed by State Assemblyman Steve Englebright, County Legislators Rob Trotta and Kara Hahn, as well as by Brookhaven Town Supervisor Edward Romaine and Councilman Jonathan Kornreich. The Mayor and Trustees of the Village of Head of the Harbor are also on record as being opposed to the development and in favor of preserving the open space. We need to agree upon the value and find the money to adequately compensate Gyrodyne for their land. In the meantime, we are left with no choice but to litigate.
